CHERRY PICKED TRAVEL GENERAL TERMS & CONDITIONS

Prices shown on the Cherry Picked Travel website for air travel are based on low season airfares and are an indication only. The confirmed price for air travel will be emailed to the client once a request for a quote and availability is made. Accommodation and add-on pricing is correct at the time of compilation, but will vary depending on the date of travel requested. All prices in the final confirmation will be correct at the time of quoting, but will not be confirmed until a deposit is taken to secure the booking.

Cherry Picked Travel Pty Ltd does not accept responsibility for any change in prices or variation of services as shown, and all services and prices are subject to change without notice, prior to full payment being received for the booking.

Cherry Picked Travel Pty Ltd has taken due care and responsibility to verify and check all information on our web site as at the time of publishing, however, as this information is supplied by the relevant airlines, accommodation & tour/cruise operators, it does not accept responsibility for any inaccuracy.

Sales of services and products through our website are made by Cherry Picked Travel Pty Ltd acting as agent for the person, business or company providing the services. Cherry Picked Travel does not accept responsibility for any negligence on behalf of the travel supplier, but will assist with making reasonable resolution to any problems that may occur.

It is essential that you check with us, for any changes or variations to the information shown on our web site. This will allow us to advise you, of any such changes that we are aware of either before you book your holiday, or prior to your departure.

All prices are quoted in AUD and required to be paid in AUD, unless specifically stated otherwise.

TERMS AND CONDITIONS OF BOOKING

Rates and Price Variations: Once a Cherry Package has been selected, and an enquiry for a quote and availability has been requested, the accurate pricing and availability will be emailed to you within 3 working days. This price will not be confirmed until a deposit has been received to secure the booking. We reserve the right to vary prices and rates in the event of changes in exchange rates or price rises made by wholesalers or other suppliers prior to full payment being received for a booking made. If the cost of any service increases due to exchange rate fluctuations, price increases, tax changes or any other reason, you are required to pay the increase when notified by us or you may cancel the booking which may result in cancellation fees. We are not liable in any way if any increase occurs. Rates quoted are appropriate to the particular product at the time of quoting and these rates may change prior to the travel date. All prices are subject to availability and can be withdrawn or varied without notice until full payment has been received.

Deposits : For Bookings made within 45 days of travelling, full payment is required at the time of confirmation.

For all other bookings, a non-refundable deposit of $220 per person is required for international bookings and $110 per person for domestic bookings to confirm land arrangements such as accommodation, tours, cruises, and other services. In addition to this full payment is required for air travel. This amount will be advised at the time of confirmation. The balance of the booking will be payable 45 days prior to departure.

Some accommodation, and land arrangements will require additional deposits required by the supplier and may vary. This will be advised on the individual booking page, and we will also advise you at the time of confirmation of your booking.

If you are travelling over Christmas, New Year or Easter, or attending a special event, the deposit may vary and final payment due dates will be 60 days prior to travelling.

Bookings made less than 45 days prior to travel : Bookings made within 45 days of travel must provide a credit card guarantee at the time of booking, if the booking is available exactly as shown on the confirmation email. Full payment will automatically be taken, and cancellation charges will be charged if the booking is then cancelled.

Final Payment : Final payment is due 45 days prior to travel date. No vouchers will be issued until final payment is received. Final payment conditions for certain accommodation and tour products may vary, these are shown on the individual pages. We will advise you in writing of these conditions at the time of booking. Please note the final payment may vary from the original booking price or quote if the product is subject to exchange rate fluctuations or price rises by wholesalers or other suppliers. We will endeavor to notify you of this increase when possible so that price increases can be avoided if the booking is paid in full before this time.

Service Fees : Prices quoted in the confirmation email will include all taxes and service fees. Cherry Picked Travel reserves the right to charge service fees for booking products and services.

Taxes : Certain taxes are mandatory in various countries. There may also be an additional local tax charged at some airports. All taxes are subject to change without notice.

STANDARD CANCELLATION POLICY

Generally we are bound by the terms and conditions required by the travel supplier. It is extremely important that travel insurance is taken out at the time of paying a deposit to cover you for cancellation due to an unforeseen event. Not all events are covered by travel insurance, so it is important to check with your agent or insurance company as to what is covered by the policy selected.

Deposited bookings cancelled 60 or more days prior to travel: Deposit is non-refundable. In addition to this you will be charged any cancellation fees that are levied by the supplier plus a $300 per person cancellation fee from Cherry Picked Travel. This will be deducted from the supplier refund.

Fully paid bookings cancelled 60 days or more prior to travel: Deposit is non-refundable. In addition to this you will be charged any cancellation fees that are levied by the supplier plus 10% of gross booking value or $300 per person cancellation fee from Cherry Picked Travel – whichever is higher. This will be deducted from the supplier refund.

Fully paid bookings cancelled within 60 days of travel: Unless otherwise stated, bookings cancelled inside 60 days are generally non refundable, however refunds will be according to the travel suppliers terms and conditions. If any supplier refunds are applicable, Cherry Picked Travel will retain the original commission amount.

Cancelling and rebooking: If you cancel a booking and re-book another holiday to a lesser value, Cherry Picked Travel will retain the original commission amount, or a $300 per person cancellation fee, whichever is the lesser amount. All cancellations must be made in writing to the consultant who is handling the booking.

FLIGHT CANCELLATION POLICY

Domestic Flight Bookings are totally non refundable or transferable. A credit may be applicable if the cancellation is made prior to 72 hours to travel date.

International Flight Bookings will incur cancellation fees. These fees vary depending on the fare type you have booked. All of the flight booking conditions will be emailed to you at the time of confirmation.

Cancellations must be in writing and should be addressed to the consultant handling the booking.

If a credit has been approved it is valid for 6 months from the date the cancellation was made.

GENERAL CANCELLATION POLICY

Special Cancellation Conditions: Certain accommodation and tour products will apply additional cancellation charges. These cancellation conditions and costs will appear on your confirmation email.

FEES

Itinerary planning fee – $220 per itinerary, refundable upon making a booking. You will be advised before work is commenced if this fee is applicable.
Trans-Tasman airline booking fee – $33 per ticket.
Domestic airline booking fee – $33 per ticket.
Non-commissionable airline booking fee (eg. budget airlines and tickets originating outside of Australia) – $110 per ticket.
Domestic non-commissionable hotels/tours – $55 per item.
International non-commissionable hotels/tours – $110 per item.
Reservation deposit – $220 per person for international bookings, $110 per person for domestic bookings. Supplier deposit requirements are additional.
Reservation cancellation fee – $300 per person, in addition to supplier cancellation fee requirements.
Amendment fee – $55 per person, in addition to supplier amendment fees requirements.
Visa processing fee – $55 per person + Visalink fee + any Consulate fees.
Frequent Flyer bookings – International:
– $110 per ticket for single destination
– $165 per ticket for multi-destination
Frequent Flyer bookings – Domestic:
– $55 per ticket for single destination
– $75 per ticket for multi-destination.
Urgent VIP courier – Cost + 30%.
Credit and debit card surcharges: Ask your consultant for surcharge rates. All rates are in accordance with Government legislation requirements.

GENERAL TERMS & CONDITIONS

Reporting of Incidents: Any abnormal incidents including injuries, service problems, cancellation of a service or dissatisfaction must be reported to Cherry Picked Travel during the event to allow us an opportunity to rectify the situation or provide assistance.

Currency: All rates are quoted in Australian Dollars, or as otherwise indicated. All rates are subject to fluctuations of the respective currency indicated.

Payment Options: Cherry Picked Travel will happily accept payments by credit card or direct deposit. If for any reason any travel service provider is unable to provide the services for which you have contracted, your remedy lies against that provider, and not against us. In the event that payment has been made to us by credit card, you agree that you will not seek to charge back your payment to us.

Travel Insurance: It is extremely important that you take out travel insurance. It is essential that your insurance covers you for involuntary cancellation of your holiday including airfare(s). For information on the policies sold by Cherry Picked Travel please ask your consultant for details.

Single Supplement Costs: If not shown in your selected accommodation cost, this is available on application.

Governing Laws : The Customer submits to the exclusive jurisdiction of the courts of the State of Queensland, including all relevant courts of appeal should any dispute arise.

Liability : We do not accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements. We do not accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by force majeure or any other event which is beyond our control and which is not preventable by reasonable diligence on our part.

Agency : We act as an agent only. We sell various travel related products on behalf of numerous transport, accommodation and other service providers, such as airlines, coach, rail and cruise line operators. Our obligation is to make travel bookings on your behalf and to arrange relevant contracts between you and travel service providers. We have no responsibility for these services nor do we make or give any warranty or representation regarding their standard. All bookings are made on your behalf subject to the terms and conditions and limitations of liability imposed by these service providers. Your legal recourse is against the specific provider and not us. If for any reason, any travel service provider is unable to provide the services for which you have contracted your remedy lies against the provider and not with us.
